Court Issues Order on Request to Show Cause
This week District Court Judge Timothy Williams issued an order on Class attorneys' request for an order to show cause. What Judge Williams did on the 24th of January was to essentially formalize his minute order issued on the 22nd of December, reminding us that the judicial system may not move as quickly as some might prefer.
As I read the order, the Judge concluded that Pulte's notice letter to Sun City residents was in violation of certain notice provisions of Nevada law on civil procedure. As a result of that finding, the Judge ordered Pulte to cooperate with the Class attorneys and he ordered
that an evidentiary fairness hearing be held within 30 days to consider the fairness and legality of Pulte's offer to Sun City residents.
One can anticipate that there will be considerable interest in the outcome of that fairness hearing, yet unscheduled. We've learned that Pulte's appeal for relief to the Supreme Court was denied.
