ELECTION UPDATE

· Voting Update.

 

    In an unusual turn of events, the Association, through their ultimate spokesperson, Chris Haines, had initially informed The SCA View that their decision not to include prepaid postage on return ballot envelops was based on an opinion rendered by the State of Nevada’s Ombudsman Office, which administers the law for common interest communities like Sun City Anthem. While that knowledge provided some measure of relief to those who might have been concerned that the Association was not in compliance with voting procedures mandated by the statute, that relief was very short lived.

 

    According to Ombudsman Eldon Hardy in a statement to The SCA View, his office never rendered such an opinion and would never do so since it contradicts the statute. In view of Mr. Hardy’s denial, and backing away from his earlier position, Chris Haines is now no longer claiming that their decision was based on an opinion from the Ombudsman’s Office, but, instead he says that he is now relying on what he refers to as “legal support for their position.”

 

    It now seems that Mr. Haines’ [prior] claim to The SCA View that the recent election had, and I quote, “complied with Nevada Revised Statutes” is approaching a Chicago-style political claim, mired, as it were, in quick sand absent any support from the one agency that is charged with administering the voting rules that apply to Sun City Anthem. One can only assume that looking to statutory authority for guidance is too great a burden to expect from our Association’s representatives. Some, we expect, will find this to be a troubling, but perhaps not an unexpected, result from certain parties.
